Refusal of Entry into Our Facilities

Article 1 Entry into our facilities will be refused in the following cases.

1. If any of the following is determined to apply to a person intending to use our facilities

  1. (1) The person is a member of a criminal organization or a person belonging to a criminal organization, a business or group connected to a criminal organization, or any parties related to these organizations, or a person belonging to other anti-social forces (referred to hereafter as "criminal organizations or other anti-social forces")
  2. (2) The person belongs to a company whose business activities are run by criminal organizations or other anti-social forces, or other such organizations
  3. (3) The person belongs to a company whose executives include those involved with criminal organizations or other anti-social forces
  4. (4) The person is heavily intoxicated or in a distinctly similar state

2. If it is determined that our facilities' operation is obstructed due to actions that are likely to cause considerable inconvenience to other guests at our facilities

3. If there is the likelihood of an employee of our facilities being subjected to harassment (intimidating speech or behavior, discriminatory remarks, excessive or persistent complaints, insults, slander, or any other actions that cause considerable disruption to the duties of employees; the same will apply hereafter)

4. If there is the likelihood that a person will photograph images or record the speech of an employee of our facilities, and a likelihood that the person will publish these images and recordings on social media, etc. without the approval of the employee

5. If there is the likelihood a person will act violently toward our facilities or an employee of our facilities, or the likelihood of violent demands or demands for an imposition that exceeds what is reasonable

6. If it is determined there is benefit to an organization that is likely to collectively or habitually conduct violent and illegal acts

7. If there is the likelihood of prohibited matters stipulated in these Rules and Regulations being carried out, or a likelihood of failing to abide by the cautions posted in various locations in our facilities

Suspension of Use, Expulsion, and Notification

Article 2 In the following cases, our facilities will immediately suspend use of our facilities and expel a person from the premises. If the person does not abide by our facilities' direction, police and other relevant authorities will be notified. There will be no refund of any entrance fees, admission fees, usage fees, etc. for our facilities upon expulsion. In addition, payment for any unpaid charges incurred for items, services, etc. consumed or utilized while in our facilities up to the time of expulsion must be received.

1. If any of the following is ascertained to apply to a person using our facilities

  1. (1) The person belongs to criminal organizations or other anti-social forces
  2. (2) The person belongs to a company whose business activities are run by criminal organizations or other anti-social forces, or other such organizations
  3. (3) The person belongs to a company whose executives include those involved with criminal organizations or other anti-social forces
  4. (4) The person is heavily intoxicated or in a distinctly similar state

2. If a person has acted in a manner causing considerable inconvenience to other guests at our facilities

3. If a person has harassed an employee of our facilities

4. If a person has photographed images or recorded the speech of an employee of our facilities, and published these images and recordings on social media, etc. without the approval of the employee

5. If a person has acted violently toward an employee of our facilities, or made violent demands or demands for an imposition that exceeds what is reasonable

6. If a person has carried out prohibited matters stipulated in these Rules and Regulations or posted in various locations in our facilities, or failed to abide by cautions posted in various locations in our facilities

Prohibited Matters

Article 3 Actions, etc. noted in the Addendum are prohibited at our facilities.

Restrictions on Entry into Our Facilities

Article 4 Our facilities may restrict entry or admission into our facilities in the following cases.

1. If the guest capacity for HANA・BIYORI has been exceeded

2. If the guest capacity for Kakeinoyu has been exceeded, or the capacity to accommodate men and women in their respective changing rooms is exceeded

Governing Law

Article 5 The formation, validity, performance, and interpretation of these Terms and Conditions shall be governed by the laws of Japan.

Language

Article 6 These Terms and Conditions are prepared in Japanese, and translations into other languages, including English, may be provided. In the event of any discrepancy between the Japanese version and any translated version, the Japanese version shall prevail.

Addendum: Prohibited Matters

1. Matters prohibited by both HANA・BIYORI and Kakeinoyu

  1. (1) Use of our facilities accompanied by pets, animals, birds, insects, etc., excluding guide dogs, hearing assistance dogs, and service dogs
  2. (2) Use of our facilities by a person with an acute illness such as fever, or a person likely to have any other infectious disease
  3. (3) Bringing in beverages in glass bottles or cans, or alcoholic beverages
  4. (4) Bringing in items with an offensive or strong odor, unsanitary items, and trash, etc. produced outside our facilities
  5. (5) Bringing in dangerous items such as explosive materials, and guns or knives
  6. (6) Bringing in self-propelled vehicles such as bicycles, tricycles, and skateboards
  7. (7) Four-wheeled carts, carry carts, four-wheeled carrier wagons, and similar types of carts
  8. (8) Use of fire for activities such as fireworks, campfires, or barbecues
  9. (9) Use of items such as musical instruments, speakers, tents, or tarps without permission
  10. (10) Bringing in and using unmanned aerial vehicles such as radio-controlled aerial vehicles and drones without permission
  11. (11) Smoking while walking or outside of designated smoking areas (smoke only in designated smoking areas)
  12. (12) Conducting sales, distributing flyers, etc., conducting advertising activities, holding meetings or presentations, or any other similar acts without permission
  13. (13) Commercial utilization without permission
  14. (14) Recording speech, images, or making other recordings for commercial utilization, or conducting other similar acts, without permission
  15. (15) Selling tickets such as vouchers, complimentary tickets or coupons for our facilities, or scalping for resale, etc.
  16. (16) Harassing an employee of our facilities
  17. (17) Photographing images or recording the speech of an employee of our facilities, and publishing these images or recordings on social media, etc. without the approval of the employee
  18. (18) Acting violently toward an employee of our facilities, or making violent demands or demands for an imposition that exceeds what is reasonable
  19. (19) Disturbing the safety, morals, or order within our facilities and causing discomfort or inconvenience to others
  20. (20) Acting in a manner this company deems to disturb the morals of our facilities
  21. (21) All other acts causing disturbance to the operation of our facilities

2. Activities prohibited when using HANA・BIYORI

  1. (1) Collecting plants (including seeds and fallen components), and other activities detrimental to them
  2. (2) Capturing, killing, or wounding animals (including birds, fish, shellfish, and insects)
  3. (3) Bringing in plants (including seeds)
  4. (4) Feeding animals, birds, fish, insects, etc. on the premises without permission
  5. (5) Bringing in machinery, etc. that negatively impacts animals and plants
  6. (6) Accessing areas that are fenced off, etc. to prohibit entry
  7. (7) Climbing trees and any and all kinds of ball games on the premises

3. Matters prohibited when entering Kakeinoyu

  1. (1) Use of this facility by a person who has body inkwork or body art (including tattoos, body paint, and stickers; such persons can use just the restaurant, not Kakeinoyu, if they enter and exit through the restaurant door and wear clothing so that the body inkwork, body art, etc. is not visible to other people)
  2. (2) Use of this facility by infants and pre-school age children (they can use the restaurant if they enter and exit through the restaurant door)
  3. (3) Bringing in food and beverages

4. Matters prohibited when bathing at Kakeinoyu

The term "bathing" refers to using the bathing areas (indoor baths, open-air baths), bathtubs (indoor baths, open-air baths), sauna rooms, and stone saunas.

  1. (1) Mixed-sex bathing with a person elementary school-age and older (guests who are of elementary school-age and older are not permitted to use bathing areas and changing rooms designated for the opposite sex)
  2. (2) Bathing by a person who has a serious skin disorder or a person with distinctly similar conditions
  3. (3) Bathing by a person unable to walk on their own (for hygienic reasons, wheelchairs, canes, and other assistive devices cannot be used in changing rooms, bathing areas, sauna rooms, or stone saunas)
  4. (4) Use of changing rooms or bathing areas by persons wearing diapers, regardless of age
  5. (5) Activities such as doing laundry and dyeing hair
  6. (6) Using towels or washing your body in the bathtubs
  7. (7) Reserving a space using a basin for washing, basket, etc.
  8. (8) Bringing glass bottles, glass, or other easily breakable items, food and beverages, or materials such as newspapers and magazines into the bathing areas, sauna rooms, stone saunas, etc.
  9. (9) Bathing by a person advised by a doctor not to take heated-air baths or hot-water baths
  10. (10) Bathing by a person who is extremely tired or heavily intoxicated
  11. (11) Use of the sauna rooms or stone saunas by a pregnant person
  12. (12) Bathing by a person who may fall under any of the contraindications in the hot spring component analysis
  13. (13) Bathing by a person who is currently menstruating
  14. (14) Bringing in or using cellphones, recording devices with cameras, etc., and gaming devices, etc. to the bathing areas, sauna rooms, stone saunas, etc. (such items can be brought into changing rooms, but must not be used or taken out of bags; they must be stored in changing room lockers)

5. Other matters prohibited at Kakeinoyu

  1. (1) Use of bathing areas by unaccompanied elementary school-age children, and use of sauna rooms and stone saunas by elementary school-age guests
  2. (2) Use of women's areas (bathing areas, changing rooms, rest areas, etc.) by men
  3. (3) Use of this facility while completely naked or partially undressed in areas other than bathing areas, beauty treatment rooms, and areas designated by this facility
  4. (4) Conversing in loud voices and talking on cellphones, etc. in a loud voice
  5. (5) Taking items borrowed from this facility, such as loungewear, towels, blankets, and comic books, outside of this facility
  6. (6) Taking items provided by this facility for use within this facility, regardless of whether provided free or for a fee, outside of this facility, including food and beverages, water (including hot spring water), shampoos and other toiletries, and various amenities

6. Activities that violate laws and public order and morals; activities that violate these Rules and Regulations; activities that obstruct this company's operations; activities that inflict damage on our facilities, equipment, or fixtures; activities that cause discomfort or inconvenience to other guests; and any other activity this company deems inappropriate
